Introduction
BoardSpark LLC (“Company,” “BoardSpark,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it through our compliance with this policy.
This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit boardspark.net (our “Website”) or use the BoardSpark application and related services (collectively, our “Services”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Policy applies to information we collect:
- On this Website.
- Through the BoardSpark application, including any account you or your organization creates.
- In email, text, and other electronic messages between you and us.
- At conferences, workshops, or other in-person events, when you provide contact information.
- When you interact with our advertising or content on third-party websites and services that link to this Policy.
It does not apply to information collected by:
- Us through any other means, including any other website we or a third party operates; or
- Any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website or Services.
Please read this Policy carefully. If you do not agree with our policies and practices, your choice is not to use our Website or Services. By accessing or using our Website or Services, you agree to this Policy. We may change this Policy from time to time. Your continued use of the Website or Services after we make changes is deemed acceptance of those changes.
Children Under the Age of 16
Our Website and Services are not intended for children under 16 years of age. No one under age 16 may provide any information to us. We do not knowingly collect personal information from children under 16. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have information from or about a child under 16, please contact us at hello@boardspark.net.
Information We Collect About You and How We Collect It
We collect several types of information from and about users, including:
- Information by which you may be personally identified, such as name, email address, telephone number, employer, or role (“personal information”).
- Information about your organization, board members, donors, and prospects that you or your organization uploads or enters into the Services.
- Information that is about you but does not individually identify you.
- Information about your internet connection, the equipment you use, and usage details.
Information You Provide to Us
The information we collect on or through our Website and Services may include:
- Information provided when registering an account, subscribing to a plan, or otherwise using the Services.
- Records and copies of your correspondence with us, if you contact us.
- Your responses to surveys we may ask you to complete.
- Details of transactions you carry out and of the fulfillment of your subscription. Billing information (such as credit-card details) is processed by our third-party payment processor and is not stored on our servers.
- Content you or your organization enters into the Services, including board rosters, attendance records, contribution records, meeting notes, and other engagement data.
- Your search queries on the Website or within the Services.
You may also provide information for publication or display in areas of the Services accessible to other users of your organization (“User Contributions”). Your User Contributions are transmitted to others at your own risk. Although we apply industry-standard security controls, no security measures are perfect, and we cannot guarantee that User Contributions will not be viewed by unauthorized persons.
Organization Data and Roles
BoardSpark is a business tool used by nonprofit organizations. When your organization subscribes, the organization — not the individual user — is generally the “controller” of the data entered into the Services, and BoardSpark acts as a “processor” on the organization’s behalf. Administrators within your organization may add, remove, or change access for other users, and may see engagement data about board members and staff. If you have questions about how your organization uses BoardSpark, please contact your organization’s administrator first.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Website and Services, we may automatically collect:
- Details of your visits, including traffic data, location data (general, not precise), logs, and the resources you access and use.
- Information about your computer and internet connection, including IP address, operating system, and browser type.
The technologies we use for automatic data collection may include:
- Cookies (browser cookies). Small files placed on your device. You may refuse browser cookies by adjusting your browser settings; if you do, some parts of our Website or Services may be inaccessible or not function properly.
- Web beacons / pixel tags. Small electronic files that allow us to count visits, understand usage, and measure the effectiveness of communications.
- Analytics. We may use privacy-respecting analytics tools to understand aggregate usage of the Website and Services.
Third-Party Use of Cookies and Other Tracking Technologies
Some content or applications on the Website or Services may be served by third parties (for example, embedded video, analytics, or payment providers). These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you. We do not control these third parties’ tracking technologies. If you have questions, contact the responsible provider directly.

Mobile & SMS Messaging
If you provide your mobile number and opt in to text messages, we use it only to send the reminders and account updates you requested. We do not sell or share mobile opt-in information or consent with any third parties for marketing or promotional purposes. Phone numbers may be shared only with the messaging providers that help us deliver these texts. You can opt out at any time by replying STOP. Message and data rates may apply; message frequency varies.
Disclosure of Your Information
We may disclose aggregated information about our users that does not identify any individual without restriction.
We may disclose personal information as described in this Policy:
- To our subsidiaries and affiliates.
- To contractors, service providers, and other third parties we use to support the Services (for example, hosting, payment processing, email delivery, and analytics), each of whom is bound by confidentiality and use-limitation obligations.

- With your consent.
We may also disclose your personal information:

- To enforce or apply our Terms of Use and other agreements.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of BoardSpark, our customers, or others.
Data Retention
We retain personal information and organization data for as long as your account is active and as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. When your organization’s subscription ends, we may retain data for a reasonable period to allow reactivation or export, after which we will delete or de-identify it in accordance with our internal schedules.
Choices About How We Use and Disclose Your Information
- Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of the Website or Services may be inaccessible or not function properly.
- Promotional Communications. We only add you to marketing lists if you opt in. If you no longer want to receive promotional email from us, click the unsubscribe link at the bottom of any marketing message or email us at hello@boardspark.net. This does not affect administrative messages related to your account.
Nevada residents who wish to exercise the sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to hello@boardspark.net. We do not currently sell data as defined by that statute.
Your State Privacy Rights
Depending on where you live, you may have rights under state privacy laws (for example, in California, Colorado, Connecticut, Virginia, Utah, and other states) including the right to know, access, correct, or delete your personal information, or to opt out of certain processing. To exercise these rights, email hello@boardspark.net. We will verify your request in a reasonable manner before responding. If your data was submitted to BoardSpark by an organization (for example, your employer or nonprofit board), please contact that organization directly — we will assist them in fulfilling your request.
Data Security
We use industry-standard technical and organizational measures to protect information transmitted to and stored by the Services, including encryption in transit, access controls, and password protection. Access to proprietary or confidential materials is restricted to authorized individuals. Unfortunately, transmission of information via the internet is not completely secure. We cannot guarantee the security of personal information transmitted to our Services, and any transmission is at your own risk.
Changes to Our Privacy Policy
It is our policy to post any changes we make to this Policy on this page with an updated “Last updated” date. If we make material changes to how we treat users’ personal information, we will notify you through a notice on the Website or by email. You are responsible for periodically visiting this page.
